On Friday the 31st of October 2008 Lancashire Fire and Rescue Service prosecuted Icon Design Ltd at Hyndburn Magistrates court for 5 offences under Regulatory Reform (Fire Safety) Order 2005.

Officers Peter Aspin and Chris Caton from Blackburn Fire Safety Department prepared the case.
Icon Design Ltd operates two factories in the Blackburn area manufacturing furniture and beds. A fire safety audit was carried out on one of the premises in September 2007 and revealed a number of shortfalls in the management of Fire Safety the fire alarm system, fire separation, escape routes, emergency lights and signage. This resulted in a Prohibition notice and An Enforcement notice being issued. The Company did have an enforcement notice issued to their other premises six months earlier.

Magistrates were informed that fire safety had been neglected and disregarded the severity of the breaches was worsened by the lack of fire separation to any available exits by the storage of large quantities of polyurethane foam. There were 4 large mezzanine floors that had not been approved by building regulations. The fire alarm system was inoperative and not maintained.

Warren Spencer from Blackhursts solicitors prosecuted for Lancs Combined Fire Authority

 

The magistrates commented that the aggravating factors were that the Company had been persistent from the start; they should have acted on the findings of the risk assessment and were therefore negligent and culpable. They considered the offences extremely serious as it involved the protection of the workforce.

In mitigation the defence stated that everything was now compliant and that the company were in a poor financial position.
